Terms and Conditions

Part A — Terms of Use

1. Purpose

BYOB.pt is a directory, free for users, of restaurants in Portugal that allow customers to bring their own bottle of wine, with or without a corkage fee. The site is operated by PROBITAS – Comércio de Computadores e Serviços, Lda. (“PROBITAS”), identified on the Legal Notice page.

2. Acceptance

Using the site implies acceptance of these Terms. If you do not agree, do not use the site.

3. Age

The site is intended for persons aged 18 or over, as it contains information related to the consumption of alcoholic beverages.

4. Nature of the information

The information on each restaurant (corkage fee, conditions, opening hours, contacts, menus) is provided by the restaurant itself or collected from public sources. Listings marked “To be confirmed” have not been validated by the restaurant. Restaurants may change their conditions without notice. Always confirm with the restaurant, when booking, that you may bring your own wine and the amount of the corkage fee.

5. Liability

PROBITAS is not a party to the relationship between the user and the restaurant and is not liable for the services provided by restaurants, for the accuracy of information provided by third parties, or for technical interruptions of the site, except where the law does not allow such liability to be excluded.

6. External links and partners

The site contains links to third-party websites (restaurants, maps, partners). Content marked “Partner” or “Advertisement” is commercial communication. PROBITAS does not control and is not responsible for the content of third-party websites.

7. Prohibited use

It is prohibited to systematically extract data from the site, to use it for unlawful purposes or to send unsolicited communications to the listed restaurants.

8. Suggestions and corrections

Restaurants and users may request corrections or the removal of a listing by writing to info@byob.pt. Removal requests made by the restaurant itself are handled within 10 working days at the latest.

9. Governing law and disputes

Portuguese law applies. Without prejudice to mandatory consumer protection rules and to recourse to Alternative Dispute Resolution entities, the courts of the district of Lisboa Oeste (Cascais) have jurisdiction.

Restaurant reviews

1. Who may review

Any user aged 18 or over who has actually visited the restaurant. By submitting a review, the user declares that it reflects a real, personal experience and that they have no connection with the restaurant reviewed or with its competitors.

2. How we verify

All reviews are read by PROBITAS before publication. We may ask for proof of the visit (for example, a photo of the bill). Reviews with proof are marked “✓ Verified visit”; the others are published without that mark. The month of the visit and the name chosen by the author are shown.

3. What we do not publish

Offensive, defamatory or discriminatory content; personal data of third parties; advertising; reviews written by the restaurant itself, by competitors or in exchange for any consideration; reviews that do not relate to a visit.

4. Independence

Positive and negative reviews are published according to the same criteria. Restaurants, whether members or not, cannot pay to publish, rank, alter or remove reviews. The restaurant may publish a reply. The average rating results solely from published reviews.

5. Rights of the review author

The author retains the rights to their text and authorises PROBITAS to publish it free of charge on BYOB.pt. They may request its alteration or removal at any time by writing to avaliacoes@byob.pt.

Part B — General Membership Conditions (restaurants and advertisers)

1. Parties

The membership contract is entered into between PROBITAS and the restaurant, wine shop or other advertiser (the “Member”), which is always a business or professional. PROBITAS is the sole contracting and invoicing entity of BYOB.pt.

2. Service

Publication of a listing on the BYOB.pt map and list, with name, address, location, corkage fee and conditions, booking contacts, links to menu and website, and the “Confirmed by the restaurant” badge. For wine shops, the listing includes name, address, location, contacts and website.

3. Price

During the launch period of BYOB.pt, membership is free of charge. PROBITAS may introduce paid conditions in the future; these will be notified to the Member by email at least 30 days in advance and will only apply if the Member expressly accepts them. If they are not accepted, PROBITAS may remove the listing at the end of that period. Any agreed prices are subject to VAT at the legal rate.

4. Term and termination

Membership is for an indefinite period. The Member may ask for the listing to be removed at any time by writing to adesao@byob.pt; PROBITAS removes it within 5 working days. PROBITAS may terminate the membership with 15 days' notice, or immediately in the event of false information or breach of these Terms.

6. Rights of PROBITAS

PROBITAS may edit listing texts for clarity and consistency, refuse or remove unlawful or misleading content or content contrary to these terms, and suspend a listing in the event of repeated, well-founded customer complaints, with prior notice by email.

7. Featured listings and advertising

Paid featured listings and commercial communications are always identified as “Partner” or “Advertisement”. The order in which non-featured restaurants are displayed is determined by the user's search (name, district or distance).

8. Liability

The liability of PROBITAS towards the Member, for any reason, is limited to the amount paid by the Member in the 12 months preceding the event, except in cases of wilful misconduct or gross negligence.

9. Personal data

The Member's contact data is processed in accordance with the Privacy Policy. The booking contacts published in the listing are public by the nature of the service.

10. Changes

PROBITAS may change these conditions by notifying the Member by email 30 days in advance. The Member may terminate the contract, without penalty, until the change takes effect.

11. Law and jurisdiction

Portuguese law applies. The courts of the district of Lisboa Oeste (Cascais) have jurisdiction, to the exclusion of any other.
